BOOKING PROCESS

1.1 Provisional Confirmation of Availability and Rates

  • Upon receipt of a request confirmation of availability, the applicable Villa rates and the amount of deposit required will be advised.
  • Bookings are on a ‘first-come, first-served’ basis and are for a minimum of three (3) nights, to the exception of certain period and unless otherwise specified in the confirmation of availability.

1.2 Exclusions & Additional Charges

  • Rates are based on the services specifically set out in the offer made. They do not the following services: car rental, food/soft drinks and/or liquor, personal items and expenses due to any other third parties, telephone, tours/taxis.
  • Any breakages or excessive damage to upholstery and furniture will be charged for upon departure. Please advise the villa Manageress if any such incidents occur. Fair wear and tear is accepted.

1.3 Initial Deposit

  • An initial deposit of 50% of the Villa rental charge must be paid to confirm a booking, unless otherwise specified in the confirmation of availability.
  • Before the booking is confirmed and a contract comes into existence, The Manager reserves the right to increase or decrease the agreed prices. No contract will exist between with The Manager until receipt of funds.
  • If funds are not received within 5 banking days the reservation shall be deemed to have been cancelled and The Manager reserves the right to allocate the Villa to another client.
  • Should the booking be cancelled, cancellation charges will become payable in accordance with Clause 3.

PAYMENT

  • Transfer of the outstanding balance must be paid at least 30 days before the day of arrival, unless otherwise specified in the confirmation of availability.
  • If The Manager does not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply.
  • If the booking is within 30 days of the arrival, the whole amount of the Villa rental is to be paid at the time of booking. This is applicable for all seasons.

CANCELLATION & AMENDMENTS TO RESERVATION

  • If it becomes necessary to cancel all or any part of the booking, The Manager must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received.
  • The following cancellation charges will be applicable depending on when the notification of the cancellation is received in writing and the period of stay in the Villa:
  • Standard and Peak Seasons:
    30 days or more before arrival date: All Payments are forfeited but credit can be given for 9 month from the date of the cancellation by The Manager. The credit can be used by the client or anyone on their behalf to the same maximum number of people during this period and solely for the villa initially reserved.
  • Within 30 days of arrival date:
    All rental payments are forfeited.
  • Christmas and New Year Period bookings:
    All rental payments are forfeited.
  • Early departure penalty will be subject to negotiation with our villa Manageress on Koh Samui.

ARRIVAL & DEPARTURE TIMES

  • Guests should assume that the Check in Time is 3:00pm and Check Out time is 10:30am (early arrival and late departure upon availability of the villas on agreement with the villa Manageress).
  • The Client is responsible for informing the correct arrival details (flight number) whenever an airport transfer is part of the service.

ALTERATIONS AND CANCELLATIONS BY THE MANAGER

  • If, for any reason beyond our control, we are unable to provide you with the Villa booked, The Manager shall reserve the right to cancel the reservation. For example, but not exclusive, if the properties are damaged or rendered unusable The Manager will endeavour to locate an alternative property for the period required but no guarantee is given that this can be done. However, if this is not possible, The Manager will cancel the booking and refund in full. The Manager shall not be liable for any further obligations or claims by the client.

REGISTERED GUESTS

  • Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity indicated in the property description or elsewhere, except in the case of infants (under two years old), or unless specifically authorized.
  • Should the owner or villa Manageress find that the number of people staying at the property exceeds that on the booking form or the maximum capacity of the villa, they may, at their absolute discretion, ask the extra person or persons to vacate the property forthwith.
  • Please note that no pets are allowed on the entire property, and smoking is only allowed outside in the grounds of the villa, not inside.

SECURITY DEPOSIT

  • A security deposit may be asked for upon arrival at the Villa. This is to cover the cost of any damage or breakage’s during the rental period of the Villas or their contents. It may also be used to cover the cost of the use of telephones and other services.
  • This amount will be returned to you at the time of departure, less any such costs or additional services.

INSURANCE

  • It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
  • The Manager or any of its agents are held harmless by you and your party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.
  • The Manager shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of The Manager’s control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.
  • By acceptance of this contract it is assumed by The Manager that this requirement has and will be complied with in full.

COMPLAINTS

  • The descriptions on the website and elsewhere are made in good faith.
  • The Manager accepts no responsibility for any modifications made which are not mentioned on the website or anywhere else that are beyond its control. Furthermore, The Manager cannot be held liable for the breakdown of the supply of water, or electricity, nor of swimming pool filtration systems, though we will use our best endeavours to arrange for any such problems to be solved quickly.
  • The Villa is part of a secure luxury beachfront development Samui Beach Village. Please observe the practice within Samui Beach Village and be considerate to the neighbours. The Manager cannot be held responsible for any acts or activities outside the villa.
  • In the Summer low tide season when the reef is dry for up to 100m, this opens the beach and reef up to all sorts of other activities such as beach volleyball, football or simply exploring the rock pools and collecting shellfish, a safe and ideal exciting activity for children.
  • Please note that from time to time there can be some works or activity by any of the villa owners on Samui Beach Village, which we cannot be held responsible.
  • If there are any problems during the rental period, which could not be solved by dealing directly with the local villa staff, please contact the Manager, and we will use our best endeavours to rectify the situation.

CONDUCT & BEHAVIOUR

  • The person paying the deposit for the villa rental is responsible for the correct and appropriate behaviour of the guests staying at the Villa/s. Should any member of the party not behave in such a manner, either the owners, the villa Manageress or a local representative may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith. In such a case, this will be treated as a cancellation of the original booking and no refund can be claimed from The Manager.

STAFF AT THE VILLA

  • The services of some staff may be included at the villa (ie Villa Manageress, maid, maintenance, Thai Chef). Additional services such as those of cooks and/or drivers can be sourced, although such services cannot be guaranteed depending on availability. Please give as ample notice as possible; especially at peak holiday seasons and we shall try to assist.

LINEN & TOWELS

  • Linen and towels are provided at the Villas. These are normally changed every three (3) days. If you require more frequent changes there may be extra charges. Limited laundry facilities exist on site and charges are made per item. Outside services are available for Guest laundry for a small service charge and must be paid at the time incurred or latest at the time of departure.

VALUABLES

  • A personal safe is provided in the villa and it is the responsibility of the client to use them at their own discretion.
  • Any valuables left at the property are under the guest’s sole responsibility and own risk. Neither The Manager nor any of the staff are responsible for their loss or damage.

DUE CARE AND SUPERVISON

  • As part of this agreement Guests are required to take due care when residing at the villas and especially children playing in the gardens or water; near the entrance from the main road; near or in the pool or Jacuzzi, on the beach, including the sea.
  • Furthermore Guests are reminded not to enter the Villas wet as the floors can be slippery. Injury, damage or injury arising shall not be the responsibility of The Manager in any way whatsoever.
